Seller Agreement
Effective date: October 22, 2026 · Last updated: October 22, 2026
1. Overview
This Seller Agreement ("Agreement") governs your use of GamiumExchange ("Platform") as a seller or consignor. By submitting a deposit request, you accept these terms in full. GamiumExchange operates as a consignment marketplace: you retain ownership of your item until it sells, at which point title transfers directly to the buyer.
2. Consignment Relationship
When you ship an item to the vault, you are consigning it to GamiumExchange for the purpose of authentication, storage, and resale on your behalf. GamiumExchange acts as your agent and does not purchase your item outright.
- You remain the legal owner until a buyer's payment clears.
- GamiumExchange may photograph, authenticate, and grade the item for listing accuracy.
- You may request withdrawal of an unsold item at any time; outbound shipping fees apply.
3. Item Eligibility & Accuracy
You represent and warrant that:
- You are the lawful owner of the item, or are authorised to sell it.
- The item is not stolen, counterfeit, or subject to any lien or encumbrance.
- The condition description you submit is accurate and complete.
- All original components listed are present and unmodified.
If the vault team grades an item lower than your declaration, the item will be returned to you at your expense and the listing will not be published.
4. Fees & Proceeds
A platform fee is deducted from your proceeds when an item sells. No fee is charged if an item does not sell. See the Fee Schedule for current rates. Proceeds are credited to your GamiumExchange wallet within two business days of the buyer's payment clearing.
5. Vault Custody
While your item is in the vault it is governed by the Vault Custody Policy, including our liability terms.
6. Prohibited Items
You may not list items that are counterfeit, recalled, illegal in the buyer's jurisdiction, or that violate any third-party intellectual property rights. GamiumExchange reserves the right to reject or delist any item without notice.
7. Termination & Disputes
Either party may terminate the consignment relationship for an unsold item by arranging a withdrawal. GamiumExchange may suspend your seller account for repeated misrepresentation, chargebacks, or violation of these terms. Disputes are subject to binding arbitration under the rules of the American Arbitration Association.
8. Limitation of Liability
To the maximum extent permitted by law, GamiumExchange's aggregate liability to you shall not exceed the sale price of the specific item giving rise to the claim. GamiumExchange is not liable for indirect, consequential, or punitive damages.
9. Changes to This Agreement
We may update this Agreement from time to time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance.
